Government Order 108 Increasing Fine Amount on Traffic Violations

PLEASE NOTE: NEW FINES ARE APPLICABLE FOR COMPLETE ANDHRA PRADESH STATE. WE HAVE NOT ENFORCED THEM IN HYDERABAD CITY, THEY WILL BE ENFORCED AT HYDERABAD CITY AFTER A AWARENESS PROGRAMME ABOUT THE INCREASE.

The following notification will be published in the Extra-ordinary issue of the Andhra Pradesh Gazette, dated: 20-08-11



2. The Traffic Police have represented for enhancement of Compounding Fee Under Section 200 of Motor Vehicles Act as the present amounts of fine are low and the traffic violators are not feeling the pinch of it. Considering the aspects of  the  Road  Safety,  traffic  regulations traffic  violations  and  after  careful examination Government considered revising the rates of Compounding Fee for better enforcement of provisions of the Motor Vehicles Act.

In exercise of the powers conferred by Section 200 of the Motor Vehicles Act, 1988(Central Act, 59 of 1988) and in supersession of the notification issued in  G.O.Ms.No.54,77,242  Transport,  Roads  &Buildings(Tr.I)  Department  dated
28.03.2006, as amended vide G.O.ms.No. 77 Transport, Roads and Buildings (TR.I)  Department, Dated;3-5-2006 and G.o.ms.No.242, Transport Roads and Buildings (TR.I)  Department, Dt;27-11-2006; the Governor of Andhra Pradesh hereby specifies the officers of the Transport Department not below the rank of Assistant  Motor  Vehicles  Inspectors  to   compound  offences  under  sectio177,178,179,180,181,182(1),182(2),183,184,186,189,190(2),192(1),194(2),196 and 198 of  Motor  Vehicles Act 1988, and officers of the Police Department in uniform not below the rank  of Inspector of Police and also Sub-Inspectors of Police(Traffic)  wherever  separate  traffi police  stations  exist  in  Municipal Corporations(Metropolis)and Municipalities and the inspectors of police in other places         to                          compound                       the                offences         under sections
177,178,179,180,181,182(1),183,184,186,189,190(2),192(1),194(2),196 and 198 of Motor Vehicles Act 1988, and officers of the Police Department not below the rank of the Sub-Inspector to compound the visible offences namely non-wearing of helmets, non-wearing of seat belts(Under Section 177), driving without license (Under  Section           181,  ove speeding(Unde Section  183(1)  and   using  of cell/mobile phones while driving (Under Section 184) of the Motor Vehicles Act
1988 and that the  compounding fee shall not be less than the rates indicated in the schedule.

4. The compounding fee collected by Police and Transport officials should be remitted into  Treasury by Challan under the Head of Account 0041-Taxes on vehicles;(101)Receipts under the Motor Vehicles Act Receipts under the Indian Motor Vehicles Act-SH(03)-Compounding Fee under Section 86 and Section 20 of Motor Vehicles Act .

    Dear Sir,



    The suggestion to make fines proportional to the value of the vehicle is in line with the very principles behind the GO issued in this regard.

    Consider this scenario.

    A person in a 50 Lacks BMW jumps a signal.. and is made to pay 1000 rupees fine for it.. he can easily afford it like a cinema ticket and hence will violate again and again. ( AS HIS MONTHLY INCOME MIGHT BE IN LACKS) This can also be implemented against heavy vehicles as they have high value as well

    Where as a poor person accidentally is caught in the middle of the road in cheap automobile when the light goes red as he was stuck in congestion and duely crossed the STOP LINE ON GREEN is made to pay RS -1000 --- it greatly affects his monthly budget and might also lead to complications in case his children go to school or he has a sick family member etc. ( As most Pay Scales for poor citizens are yet to catch up with the growing cost of living in the city)

    Making the fines proportional to the value of the vehicle will also reduce accidents as most cars that race etc are high end vehicles that cost alot.And also consume alot of fuel. We will not only be helping road safety but also environmental safety.

  2. i second Piyush on this and would also say that ask Government folks to first make better/wider roads that people need not break the rules...without making any changes this would look like money collection agents rather than educating people about the rules...

  3. I agree with Piyush and Kishore. People need better traffic management and better traffic education. What can be done is instead of fining the person for the first or second time, he/she should be given an option to either attend a traffic school or pay the huge(or may be small for some people)fine. Now this traffic school should have educational videos and literature which would educate a citizen about traffic rules in layman terms. If the same person repeats the exact same mistake again then we could fine the person without the option of attending the traffic school and also introduce a points system which would be able to suspend a driver's license for a particular period of time(say six months) if he/she has reached a set number of offenses in say like a 2 year period(just an example).

    On the other hand government also needs to make some changes on their end for the citizens to comply and get accustomed to the new rules and regulations. First of all we need, better traffic signals, which operate evenly. By this I mean traffic signals which have even time distribution between change of lights from Red-Orange-Green in all parts of the city. Secondly, more visible signs and signals. By this I mean signs and signals that are visible from a good distance and which tell you what's coming ahead. Third would be the need to make dedicated pathways for pedestrians...

  4. Signal jumping should be fined only when the vehicle doesn't stop at all as some times in a tricky situation the vehicle may stop on the pedestrian crossing. At least such cases should be less fined compared to those who jump the signal and don't stop. I also agree with Piyush in his argument.

MostTRAFFIC police at the junctiones are freshers the seniors would be sitting under a tree or in the adjacent hotels... the do not even know he rules properly... the other day when the signal to his right was green, he waves the vehicles opposite side to him to proceed which created utter chaos at Musheerabad.... when asked he says sorry
    First these people should start educating the staff rather than collecting the fines from public...

  6. Because of these high Fine rates(500 to 5000 Rupees) ..... Generally Normal people cant afford that much amount incase they violate the rules so this is making the chance to some officials to take the bribes... people also giving more priority to give bribes insted of paying that much high Fines amount ...so the corruption taking place.... mu thought is if we have lower fine rates peoplae can easily pay the fines and corruption may decrease it should depend on vehicles.... ...

  7. Its good to have such hefty fine system.. this will discourage a large group of people who violate purposely.

    For the BMW guy he will not bother even if the fine is 10,000.... a solution need not be 100% effective , atleast if it solves 80% of the problem the rest will line up.
